1. Agreement and store terms
These Terms of Use (“Terms”) apply to the PreCalm mobile app and related PreCalm website, published by Equilibelle App Solutions (“PreCalm,” “we,” “us,” or “our”). By downloading, purchasing, or using PreCalm, you agree to these Terms. If you do not agree, do not use the app.
Your download and purchase are also subject to the rules and terms of the Apple App Store or Google Play, depending on your platform. Where mandatory store terms or applicable consumer law conflict with these Terms, those mandatory rules apply.
2. General-wellness preparation, not health care
PreCalm is designed to help you prepare for speaking moments through short routines, gradual practice, optional personal check-ins, and private preparation prompts. It is a general-wellness and speaking-preparation tool.
PreCalm does not provide medical advice, diagnosis, monitoring, prevention, or treatment. It is not therapy, emergency support, or a substitute for care from a qualified medical or mental-health professional. Do not use PreCalm to make medical decisions.
Use breathing and movement guidance only when it is safe and comfortable for you. Do not force or hold your breath. Stop the exercise, return to normal breathing, and seek appropriate help if you feel uncomfortable, lightheaded, unwell, or unsafe.
3. Permission to use PreCalm
Subject to these Terms and applicable app-store rules, we give you a personal, limited, revocable, non-exclusive, non-transferable licence to use PreCalm on compatible devices you own or control for your own lawful purposes.
PreCalm's software, design, artwork, written guidance, branding, and bundled content are owned by or licensed to Equilibelle App Solutions and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.
4. Founding Pro — Lifetime Access
Founding Pro is an optional, one-time, non-consumable in-app purchase. It is not an automatically renewing subscription. The app store shows the current local price, currency, and any applicable tax before you approve payment.
Once the store confirms the purchase, Founding Pro unlocks the Pro features identified on the in-app purchase screen at the time you buy. Your entitlement does not expire on a monthly or annual billing date, and we will not convert that purchase into a recurring subscription.
Free and Pro access at launch
Without Founding Pro, PreCalm includes every 60-second routine—both Quick and personalized—practice levels 1–2, one concurrently upcoming event, the Snowfall visual environment, and the Quiet Snow ambient sound. Completed and past events and all saved history remain accessible without Pro.
Founding Pro adds 3- and 5-minute routines, practice levels 3–5, additional concurrently upcoming events, and all visual and audio choices marked release-approved in the app. The in-app purchase screen shows the current included feature set before you buy.
What “Lifetime Access” means
Lifetime Access means access to the included on-device Founding Pro feature set without another recurring fee, for as long as PreCalm remains offered and technically supported on a compatible platform. It is not a guarantee that every device, operating-system version, store, or individual feature will remain available forever, or that unrelated future products and services will be included.
Restoring access
You can use Restore Purchases in PreCalm on a compatible device using the same Apple or Google app-store account on the same platform where you purchased. Store and platform rules determine restoration eligibility. An iOS purchase does not automatically transfer to Android, and an Android purchase does not automatically transfer to iOS.
Future services
Future optional services with material ongoing costs—such as cloud storage, generative or usage-priced processing, live services, or third-party content—may be priced and sold separately. Founding Pro does not automatically include those separate services. Any separate price or recurring charge will be clearly disclosed and will require your express approval before purchase.
If Founding Pro is later withdrawn from sale, that does not by itself turn an existing purchase into a subscription or remove a valid entitlement. Continued access still depends on compatible store, platform, app, and technical support as described above.
5. Billing, cancellation, and refunds
Apple or Google is the seller and payment processor for in-app purchases. The applicable store handles charging, receipts, tax, payment methods, and refund requests under its own rules. Because Founding Pro is a one-time purchase, there is no recurring plan to cancel.
If a purchase is reversed, refunded, disputed, revoked, or found invalid by the store, access to the corresponding Pro entitlement may be removed. This does not limit any non-waivable refund or consumer rights you have under applicable law.
For a missing entitlement, first use Restore Purchases and then visit purchase support. For a refund decision or payment-account issue, contact the store where you made the purchase.
6. Your local data and privacy
PreCalm stores private preparation content locally on your device. You remain responsible for your opening sentences, notes, event details, and other information you enter. Do not enter content you do not have the right to use.
Deleting local records, clearing app storage, changing devices, restoring a device, or uninstalling the app may permanently remove information. PreCalm does not offer cloud sync or a server backup of your preparation records, so we generally cannot recover them.
Purchase validation involves limited store, entitlement, receipt or token, and technical information, as explained in the Privacy Policy.
7. Updates and availability
We may update PreCalm to improve reliability, safety, accessibility, compatibility, design, or features. We may add, change, or remove features where reasonably necessary. Some changes may be required by app stores, operating systems, laws, security needs, or third-party service changes.
We do not promise uninterrupted or error-free operation. Device compatibility, local notification delivery, device narration, store purchasing, and restoration can depend on services or settings outside our control. We may discontinue PreCalm or support for an older platform, with reasonable notice where practicable.
8. Responsible use
You agree not to:
- use PreCalm unlawfully, to harm another person, or in a way that interferes with the app or related services;
- circumvent purchase checks, tamper with entitlements, submit fraudulent transactions, or misuse restoration;
- copy, distribute, sell, rent, sublicense, or commercially exploit the app or its content except where applicable law expressly permits; or
- attempt to access systems or information you are not authorized to access.
We may limit or end access where reasonably necessary to address fraud, abuse, security risks, legal requirements, or a material breach of these Terms. Mandatory store and consumer rights remain unaffected.
9. Disclaimers
To the fullest extent permitted by applicable law, PreCalm is provided “as is” and “as available.” We do not guarantee a particular speaking, confidence, wellness, performance, or health outcome. Personal check-ins and summaries are your own observations, not clinical measurements or assessments of speaking quality.
Nothing in these Terms excludes warranties or protections that cannot lawfully be excluded in your country or region.
10. Limits of liability
To the fullest extent permitted by applicable law, Equilibelle App Solutions will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, profits, opportunity, or goodwill arising from your use of or inability to use PreCalm.
These limits do not apply where prohibited by law, including liability that cannot legally be limited. Your statutory consumer rights remain unchanged.
11. Changes to these Terms
We may update these Terms when PreCalm, store requirements, service providers, or applicable laws change. We will post the revised Terms here and update the date above. If a change materially affects existing rights, we will provide additional notice where reasonably possible or legally required.
If any provision is found unenforceable, the remaining provisions continue to apply. A delay in enforcing a provision does not waive it.
